94/62/EC Packaging and Packaging Waste Directive Tests

The packaging and packaging waste directive 94/62/EC, which is in force in the European Union countries, basically aims to:

  • To harmonize national measures on packaging and packaging waste management.
  • To prevent or reduce any impact of member states and third countries on the environment, thereby ensuring a high level of environmental protection.
  • Avoiding obstacles to the functioning of the internal market and trade within the European Union, distortion and restriction of competition.

For this purpose, the said directive lays down the following measures aimed at preventing the production of packaging waste as a first priority:

  • Reuse of packaging
  • Recycling and recovery of packaging waste
  • Reducing the final disposal of such waste

For the purposes of this directive, the term packaging refers to all products made of various materials used for the protection, handling, delivery and presentation of goods, from raw materials to processed goods, from the producer to the consumer.

The packaging consists only of:

  • Sales packaging or primary packaging, i.e. packaging designed to form a form of sale unit to the consumer at the point of purchase.
  • Grouped packaging or secondary packaging, i.e. packaging designed to form a grouping of a certain number of sales units at the point of purchase, whether it is sold as such to the consumer or simply serves as a means to replenish the shelves at the point of sale.
  • Transport packaging or tertiary packaging, i.e. packaging designed to facilitate the handling and transportation of a set of sales units or grouped packages to avoid physical handling and transportation damage.

Packaging waste refers to any packaging or packaging material that falls within the scope of the definition of waste in the 75/442/EEC directive, excluding production residues. Packaging waste management means waste management as defined in the 75/442/EEC directive.

Prevention refers to the reduction of materials and substances in packaging and packaging waste, the amount of packaging and packaging wastes at the production process level and at the stages of marketing, distribution, use and elimination, and their harm to the environment.
