(EU) Directive No. 2020/1322 3-MCDP Analysis
The legal regulation (EU) 2020/1322 published in the European Union countries is a legal regulation that amends the regulation numbered 3/3 regarding maximum 3-monochloropropanediol (1881-MCPD), 2006-MCPD fatty acid esters and glycidyl fatty acid esters in certain foods.

The principles adopted in this regulation are as follows:
- 3-MCPD and fatty acid esters are processing contaminants formed during the refining of vegetable oils. It is therefore appropriate to set maximum levels for the presence of 3-MCPD and fatty acid esters for use as an ingredient in food or vegetable oils and fats placed on the market for the final consumer.
- Natural olive oils do not contain glycidyl fatty acid esters, 3-MCPD and fatty acid esters. It is therefore appropriate that these new maximum levels for 3-MCPD and fatty acid esters or the current maximum levels for glycidyl fatty acid esters do not apply to pure oils.
- BIt is appropriate to set a stricter maximum level for vegetable oils and fats for the production of infant formula and processed grain-based food for infants and young children.
- Infant formula, follow-on formula and foods for special medical purposes for infants and young children, in order to eliminate potential health problems associated with infants and young children, especially taking into account the possible exposure of infant formula-fed infants to 3-MCPD and its fatty acid esters. It is appropriate to set certain solid maximum levels, depending on whether they are sold in powder or liquid form.
- Considering that these formulas are consumed not only by infants taking formula, but also by children under 3 years old, it is appropriate to apply them at the same strict level. In addition, it is appropriate to determine the maximum level available for glycidyl fatty acid esters for infant food and to continue with the formula for infant formula.
- In addition, to ensure a high level of protection of human health, it is appropriate to set a maximum level for glycidyl fatty acid esters and 3-MCPD and fatty acid esters in fish oil and oils from other marine organisms.
