Manufacturers of industrial or institutional detergents containing surfactants, or surfactants for industrial or institutional detergents, may seek exceptions if a detergent contains surfactants whose final aerobic biodegradation level is lower than that specified in the regulation annex.

The primary biodegradability level should be measured for all surfactants in detergents that fail final aerobic biodegradation tests. Detergent surfactants with a primary biodegradability level lower than that specified in the annex of the regulation (Annex II) are not exempted.

In short, the regulation (EC) 648/2004 contains rules designed to ensure the free circulation of detergents and surfactants in the domestic market and at the same time to ensure a high degree of protection of the environment and human health. To this end, this regulation harmonizes the following rules for placing on the market of detergents and surfactants for detergents:

  • Biodegradability of surfactants in detergents
  • Restrictions or bans on surfactants on the grounds of biodegradability
  • Additional labeling of detergents, including fragrance allergens
  • Information that manufacturers should have at the disposal of the competent authorities and medical personnel of the European Union countries
  • Limitations on the content of phosphate and other phosphorus compounds in consumer laundry detergents and consumer automatic dishwasher detergents

For the purposes of this regulation, detergent means any substance or mixture containing soap or other surfactants designed for washing and cleaning operations. Detergents may be in any form (liquid, powder, paste, molds, cakes, molded parts, shapes and the like) and may be marketed or used for household or institutional or industrial purposes.
