(EC) Regulation No 1223/2009 on Cosmetic Products

In the legal regulation (EC) numbered 1223/2009 on cosmetic products published by the European Parliament and the Council, the rules that must be followed by all cosmetic products placed on the market are explained in order to ensure the functioning of the internal market and the protection of human health at a high level in the European Union countries.

(EC) Regulation No 1223/2009 on Cosmetic Products

For the purposes of this legal regulation,

  • The expression cosmetic product refers to any substance or mixture intended to be placed on the external parts of the human body (skin, hair, nails, lips and external genitalia) or teeth. This substance and mixture are mainly used to clean, scent, change their appearance, protect, keep them in good condition or correct body odours.
  • The term substance means a chemical element and compounds in its natural state or obtained by any manufacturing process, including any additives necessary to maintain its stability and any impurities resulting from the process used, but excluding any solvent that can be separated without affecting its stability.
  • The expression mixture refers to a composition or solution consisting of two or more substances.
  • The term preservatives refers to substances in a cosmetic product that are mainly intended to inhibit the growth of microorganisms.
  • The term colorants mainly refers to substances intended to color the cosmetic product, the whole or certain parts of the body by absorption or reflection of visible light.

A cosmetic product placed on the market must be safe for human health when used under normal or reasonably foreseeable conditions of use, in particular taking into account:

  • Labeling
  • Usage and disposal instructions
  • Any other indication or information provided by the identified responsible person

The manufacture of cosmetic products must comply with good manufacturing practices (GMP) in order to achieve the purposes set out in this legal regulation. Compliance with good manufacturing practices is assumed if the manufacturing is in conformity with the relevant harmonized standards.
