This directive shall apply to equipment placed or to be installed on a ship of a European Union country and for which the approval of the flag state administration is required by international instruments, regardless of whether the ship was in the European Union at the time of equipping it.

Marine equipment placed on board a ship of a European Union country must meet the design, construction and performance requirements of international instruments as applicable at the time that equipment is placed on board. Compliance of marine equipment with these requirements will only be demonstrated in accordance with test standards and through conformity assessment procedures referred to in the directive.

When European Union countries issue, approve or renew the certificates of ships flying their flag as required by international conventions, they must ensure that the marine equipment on these ships complies with the requirements of this directive.

European Union countries must take the necessary measures to ensure that marine equipment on ships flying their flag complies with the requirements in international documents that currently apply to onboard equipment.

Member states may not prohibit the placing on the market of marine equipment conforming to this directive or the installation on board a ship of a European Union country. At the same time, it cannot refuse to issue or renew certificates related to ships flying its flag.

Member states will monitor the development by the International Maritime Organization (IMO) and standardization bodies of appropriate international standards, including detailed technical specifications and test standards for marine equipment required to be used or installed on ships to increase maritime safety and prevent marine pollution.

A special mark shall be affixed to marine equipment that has been proven to comply with the requirements set out in this directive in accordance with the relevant conformity assessment procedures.
