Machinery Regulation 2023/1230/EU

Machinery Regulation 2023/1230/EU

Regulation 2023/1230 of the European Parliament and of the Council on machinery specifies health and safety requirements for the design and manufacture of machinery, related products and partly completed machinery, in order to ensure that they are made available on the market or offered as a service, while ensuring a high level of protection of the health and safety of persons, in particular consumers and professional users, where appropriate domestic animals and property, and where appropriate the environment. This legal regulation also lays down the rules for the free movement of products covered by this regulation within the European Union.

Machinery Regulation 2023/1230/EU

The machinery directive 2023/1230/EU applies to machinery and related products:

  • Interchangeable equipment.
  • Security components.
  • Lifting accessories.
  • Chains, ropes and straps.
  • Removable mechanical transmission devices.

This legal regulation also applies to partially completed machines.

For the purposes of this regulation, machinery, the related products listed in the first subparagraph and partly completed machinery are collectively referred to as products within the scope of this regulation.

The following are outside the scope of this regulation:

  • Safety components intended to be used as spare parts in place of identical components and supplied by the manufacturer of the original machine, the related product or the partially completed machine.
  • Special equipment for use at fairgrounds or amusement parks.
  • Machinery and related products specifically designed or used for use in a nuclear facility and whose compliance with this regulation could endanger the nuclear safety of that facility.
  • Weapons, including firearms.
  • Means of transport over air, water and rail networks (excluding machinery mounted on such means of transport).
  • Regulation (EU) 2018/1139 of the European Parliament and of the Council and the aeronautical products, parts and equipment falling within the definition of machinery under that regulation, to the extent that they meet the relevant essential health and safety requirements of Regulation (EU) 2018/1139 set out in that regulation.
  • Systems, components, separate technical units, parts and equipment falling within the scope of regulation (EU) 2018/858, excluding motor vehicles and their trailers and machinery designed and constructed for and mounted on such vehicles.
  • Two- or three-wheeled vehicles and quadricycles, as well as systems, components, separate technical units, parts and equipment designed and constructed for these vehicles, with the exception of machinery mounted on these vehicles, fall within the scope of Regulation (EU) No 168/2013.
  • Agricultural and forestry tractors, as well as systems, components, separate technical units, parts and equipment designed and constructed for these tractors, with the exception of machinery mounted on these tractors, fall within the scope of Regulation (EU) No 167/2013.
  • Competition motor vehicles only.
  • Marine vessels and mobile offshore units and machinery mounted on such vessels or units.
  • Machinery or related products specifically designed and constructed for military or police purposes.
  • Machines or related products specifically designed and constructed for research purposes for temporary use in laboratories.
  • Mine coiling device.
  • Machines or related products designed to move performers during artistic performances.
  • The following electrical and electronic products, to the extent that they fall within the scope of directive 2014/35/EU or directive 2014/53/EU:
    • Household appliances designed for home use, not electrically operated furniture
    • Audio and video equipment
    • information technology equipment
    • Ordinary office machines, except additive printing machines used to produce three-dimensional products
    • Low voltage switchgear and controlgear
    • Electric motors
  • High voltage electrical products, including:
    • Switchgear and control devices
    • Transformers

For the purposes of the machinery directive 2023/1230/EU, machine means:

  • An assembly of interconnected parts or components, at least one of which is moveable, and combined for a specific application, equipped or intended to be equipped with a propulsion system other than directly applied human or animal power.
  • The above-mentioned assembly is simply a device lacking the components needed to connect it to the field or to sources of energy and movement.
  • An assembly that is ready to be installed and functions as described above, only when mounted on a means of transportation or mounted on a building or structure.
  • The above-mentioned machine assemblies or partially completed machine assemblies (which are arranged and controlled to function as an integrated whole to achieve the same purpose).
  • An assembly of interconnected parts or components, at least one of which is movable and coupled together, designed to lift loads, and whose sole source of power is directly applied human power.
  • An assembly in which the installation of the software intended only for the specific application envisaged by the manufacturer is missing, as mentioned above.

Member States may lay down requirements to ensure that persons, including workers, are protected when installing or using machinery or related products, but such rules shall not permit the modification of machinery or a related product in a way that does not comply with this regulation.

The categories of machinery and related products listed in the annex (Annex I) to this regulation are subject to the relevant conformity assessment procedures.

The indicative list of security components is set out in Annex II. The Commission has the authority to add a new security component to the indicative list of security components or to withdraw an existing security component from this list in the light of technical progress and knowledge or new scientific evidence.

Machines or related products may be placed on the market or put into service only if they meet the essential health and safety requirements set out in Annex III, when properly installed and maintained and used for their intended use or under reasonably foreseeable conditions.
