Regulation on the Prohibition of Chemicals

The prohibition of chemicals regulation is a legal regulation that includes prohibitions and restrictions on the marketing of certain dangerous substances and mixtures, as well as certain materials that contain or release them. This German regulation, which regulates four substances or mixtures today, has nothing to do with the REACH (registration, evaluation, authorization and restriction of chemicals) directive in force in European Union countries.

Regulation on the Prohibition of Chemicals

The regulation on the prohibition of chemicals covers the following products:

  • wood-based materials
  • Detergents, cleaning and care products
  • textile products
  • Products containing artificial mineral fibers
  • Substances, mixtures and products containing dioxin and furan

Advanced laboratory testing is required to implement this chemical safety regulation. However, if it is known to what extent each material should be tested for which contaminants, the scope of testing is considerably narrowed.

Individual chemical prohibitions or restrictions specified in the regulation are included in the annex of the regulation. In addition to the names, this list includes the index of substances and their European Union and CAS numbers for classification in the relevant contexts.

Especially in developed countries, various levels of prohibition and restriction lists are created to protect human health and the environment from harmful chemicals. At European Union level, the REACH directive regulates the use of chemicals of very high importance for this purpose. Items are then reviewed to assess whether they meet the criteria of this directive. When this is verified, the substance in question is included in the list of candidates for inclusion in the authorization list annexed to REACH. After this point, companies have to notify the parties in the supply chain of this situation.

The chemical prohibition regulation valid in Germany is an example of prohibition and restriction lists in a national context. This legal regulation, which entered into force in 1993, regulates the protection of people and the environment from harm caused by various chemicals and compounds. Restrictions and prohibitions on occupational safety are mainly dealt with in this regulation. This regulation was revised once again in 2017 to comply with the current European Union legal regulations.
