Consumer Product Safety Act (CPSA), Section 14(a)(5) - Tracking Labels

Children's products designed or intended primarily for use by children aged 12 and under must have distinctive permanent markings (tracking labels). These labels must be affixed to the product and its packaging and must provide certain identifying information. Companies that import, manufacture and label durable baby or toddler products must meet outer packaging labeling requirements beyond basic tracking label requirements.

Consumer Product Safety Act (CPSA), Section 14(a)(5) - Tracking Labels

All tracking tag information must be visible and legible and contain certain essential information, including:

  • Manufacturer or private labeler name
  • Place and date of manufacture of the product
  • Detailed information about the production process, such as batch or run number or other identifying features
  • Other information to facilitate the identification of the specific source of the product

All tracking tag information must be visible and legible. When an ingredient is identified as a hazard or source of violation, the tracking label helps identify other products containing the same ingredient.

The relevant legislation is contained in section 14(a)(5) of the Consumer Product Safety Act (CPSA). These requirements were previously part of section 103 of the Consumer Product Safety Improvement Act (CPSIA).

A tracking label is an abbreviation for “to distinguish permanent marks” in section 14(a)(5) of the CPSA. If a product already contains some or all of the required information, manufacturers do not need to copy existing markings onto a new label, and any necessary additional distinctive permanent markings can be added to an existing label. All marks on which the manufacturer relies must be permanent and the product must still meet all the requirements set forth in section 14(a)(5) of the CPSA.

The tracking label should include the manufacturer and eventual buyer's manufacturer, information such as the place and date of manufacture of the product, batch, run number or other identifying characteristics, and other information determined by the manufacturer to help identify the specific source of the product.
